DOE has determined that the comments received in response to the direct final rule do not provide a reasonable basis for withdrawing the direct final rule.  

DOE is also announcing it will host a public meeting on June 20, 2016. 

DOE is also offering an opportunity for the public to submit petitions to amend this final rule and to submit comments regarding any timely-submitted petitions received by DOE.

The comment period is reopened until June 15, 2016.

For the construction industry and affected Sheet Metal and Air Conditioning Contractors’ National Association (SMACNA) contractors, potential silica exposures are found in tasks that include drilling and cutting concrete and stone.
